Nguyen Hoi Ngoc (resident of Thu Duc) said that he bought a Honda Vision motorcycle from a used motorcycle shop in Binh Thanh district. On August 18, Mr. Ngoc went to re-register the number plate, then “taped fire” the new regulation that requires the old owner to complete clearance procedures to be able to register.

Mr. Ngoc contacted the store and they told him that the old owner had returned to his hometown in An Giang province by the end of September, so he could return to Ho Chi Minh City to help Mr. Ngoc with the processes. Since then, Mr. Ngoc has not dared to drive this car on the road for fear of being investigated by the traffic police, nor does he know if he will be able to register it in the near future.

Ngoc said people still know that this regulation is to manage and protect property and people’s interests in the long run. However, we hope that the authorities may have a plan to resolve this quickly to simplify the process and make it more convenient for people.

And Mr. Khoa (28 years old, employee of a used motorcycle shop on Hoang Van Thu Street, Phu Nuan District) said that the owner encountered difficulties in the business process.

Khoa said that in the past, when selling a car through a shop, the old owner would often sign a power of attorney (usually 10 years) so that the shop could handle the paperwork with the new owner on the old owner’s behalf, and the same Do other procedures also at the same time. according to the law. But according to Circular 24, car owners will have to go through the recall procedures directly, creating a “headache” for used car buyers and sellers.

Khoa shared, “Many car owners have gone abroad or are lost or cannot be contacted, so finding the old owner involves going through the procedures of canceling the vehicle registration and license plate and getting the original records back.” It’s very difficult.”

Not only that, on September 5, the used motorcycle shop where Mr. Khoa works sold a car to a customer, luckily the shop found the old owner, so they took the owner to the District 7 police to complete the recovery procedures. However, in the police appointment letter, the previous owner of the car was scheduled to come to the District 7 Police Department to receive the results on September 25 (i.e. 20 days later).

Verify Vehicle Origin: After 30 days, no disputes can be transferred

Implementation of regulation on identification number plates as per circular 24 still faces many difficulties due to system errors. The department confirmed, “Through the monitoring of vehicle registration and management data, the number of documents processed daily across the country is basically equal to the number of documents processed before the circular came into effect and the system is in use.”

Regarding the problems of used car shops, the traffic police department said that according to the regulations, when purchasing a car, there must be an invoice or contract, and the vehicle sales certificate must be notarized and certified according to the regulations. However, in reality, there is still a situation of buying and selling a car from hand to hand, without documents transferring ownership, so the buyer cannot register the car in his own name.

To create conditions for people to register vehicles with their own owners, Circular 24 regulates the management of the registration of title transfers of vehicles that have registered vehicle purchase and sale documents or vehicles through multiple organizations and individuals. Ownership is transferred due to lack of purchase and sale documents. Illegal.

If there is a sale certificate from the vehicle owner (name on the registration certificate) and a vehicle sale certificate from the last seller, it will be resolved within two days.

If there are no vehicle purchase documents or invalid vehicle purchase documents, the registration agency will handle the case, receive the documents, write the appointment letter within 30 days as well as send the reception notice. Vehicle owners get settlement verification across business units.

After 30 days, if there is no dispute, lawsuit over the vehicle or related to the stolen vehicle or evidence of the case, the authorities will carry out recovery procedures and resolve the vehicle title transfer as per the rules.

For vehicles sold before the effective date of Circular 24 (vehicles with license plates) and have not yet completed the name transfer, registration and license plate cancellation procedures, when completing the corresponding procedures for those vehicles, The vehicle registration agency will cancel the current registration and license plate.

At the same time, this license plate number will be kept for the old owner whose name is on the vehicle registration. This vehicle must be registered with the new identification number plate.

If the car seller has completed the registration and license plate cancellation procedures before selling the vehicle, the buyer only needs to bring the cancellation certificate to the competent authority to complete the vehicle registration procedures as per the rules.
