Circular 24/2023/TT-BCA dated 1 July 2023 on the issuance and cancellation of motor vehicle registration and license plates sets out the responsibilities of vehicle owners:
When selling, donating, inheriting, exchanging, contributing capital, allocating, transferring a vehicle (collectively known as transferring ownership of the vehicle):
a) The vehicle owner must retain the vehicle registration certificate and the vehicle license plate (not give it to the organization or individual receiving the vehicle ownership transfer) and submit the vehicle registration certificate and license plate to the vehicle registration agency for use will be. Recall procedures.
In case of transferring vehicle ownership with the winning license plate, the vehicle owner will submit the vehicle registration certificate to the registration agency for retrieval procedures.
b) Within 30 days from the date of filing of documents to transfer ownership, the vehicle owner must complete the recovery procedures. If after the above deadline the vehicle owner does not complete the recovery procedures or does not surrender the vehicle registration certificate and license plate to the organization or person receiving the ownership transfer to complete the recovery procedures, before proceeding, the agency Vehicle Registration will issue a decision. If the vehicle owner does not complete the recovery procedures after transferring the vehicle ownership, he should be held responsible before the law for the violations related to that vehicle.
c) After the vehicle owner completes the recovery process, the organization or person receiving the ownership transfer shall complete the registration process to transfer the ownership of the vehicle in accordance with the regulations.
The procedures for vehicle ownership transfer registration are prescribed as follows:
1. Memorize the procedures
a) The vehicle owner declares the cancellation of the vehicle registration and license plate on the public service portal; Provide online vehicle registration record code; Submit the revocation documents specified in Section 1, Article 14 of this circular and obtain an appointment letter to return the vehicle registration results in accordance with the regulations.
b) After checking the valid vehicle records, the vehicle registration agency issues a certificate of cancellation of registration and license plate as per the rules (with a scratch copy of the engine number, chassis number and duplicate stamp of the registration agency). Vehicle registration on engine number and chassis number): 1 copy returned to vehicle owner; 1 copy of vehicle record; If the vehicle registration certificate is lost, verification will be done as per the rules.
2. Procedures for registering name transfer
a) Organizations and individuals acquiring vehicle ownership and transfer of vehicle ownership (in case of transferring the original owner): declare the vehicle registration declaration in accordance with the provisions of Article 9 of the above circular; Bring the vehicle for inspection, provide the Online Vehicle Registration Application Code and submit the documents specified in Section 2, Paragraph 14 of the above circular.
b) After checking the vehicle records and ensuring that the vehicle is indeed valid, the vehicle registration agency shall issue the license plate in accordance with the provisions of Section 2, Article 12 of the above circular.
c) Receive the appointment letter to return the results, pay the vehicle registration fee and obtain the license plate (if the license plate is issued as stipulated in point A, Section 2, Article 12 of the above circular). If the vehicle owner wishes to receive the vehicle registration result through the Public Postal Service, register with the Public Postal Service Unit.
d) Obtain the vehicle registration certificate and license plate (if the license plate is issued in accordance with the provisions of Point B, Section 2, Article 12 of the above circular) from the vehicle registration agency or public postal service unit.
If the vehicle is registered to run with the original owner, the identification number plate (5-digit plate) will be retained. If the old license plate is a 3 or 4 digit license plate, it will be converted into an identification number plate according to the regulations.
Thus, as per the provisions of the above circular, you need to complete the procedures of canceling your vehicle registration and license plate and submitting it to the vehicle registration agency in your province. After that, your brother will register to transfer ownership of the donated car in Ho Chi Minh City.
The cancellation and registration processes are done on the public service portal, whereas earlier documents had to be retrieved and submitted manually.
